Protected Land in Boronia Set For Apartment Development
BORONIA residents are to fight the building of an Apartment complex on a site previously protected by a 50-year-old covenant.
The covenant on the land, at 66 Boronia Rd, was removed after the Supreme Court approved an application that the landowner had made in 2010. Council development director Angelo Kourambas said the council rejected a planning permit to remove the covenant in 2006 which received 134 objections. The covenant, made in 1949, allowed for one dwelling, a garage and out-buildings on the property.
Mr Kourambas said people wishing to remove a covenant could either apply to the council for a planning permit or to the Supreme Court. He said the Supreme Court application “appears to have been approved” and the council was not a party to this proceeding.
An application for the development, which is on the corner of Marie St, has been lodged with council and is being advertised.
At last week’s council meeting, resident Anthony Searle said residents should have been consulted about the covenant’s removal.
Landowner Richard Short said there was no covenant on the property when he bought it less than a year ago. He did not know who the previous landowner was.
Applicant Peter Brown Architects did not return our calls.

PEOPLE POWER WINS THE DAY!
PEOPLE POWER WINS THE DAY! OCT 4 2011 People were packed tight into the building at last weeks Knox Council meeting. The map shown on the right shows the new height restrictions as decided upon by council on the night. Whilst ADBG is relieved with the outcome, large areas are still designated more than 2 storeys and the group will continue to campaign for its original proposal based on the working papers presented to council at the 2nd September meeting. Issues such as density, infrastructure and neighbourhood character still need to be addressed, and the group will continue to work as a voice for the residents. |
